A new CLARITY Act draft circulated July 22 with a temporary ethics provision sunsetting in 2029. Coinbase CEO Brian Armstrong says it is set for a full Senate floor vote. The Senate has approximately 16 days before summer recess. The bill is alive and actively moving.

Our earlier coverage called the CLARITY Act stalled before the August recess. That was wrong, and we're correcting it. The situation as of July 23 is more complex — and more encouraging — than we reported.

What Actually Happened — The July 22 Development

On July 22, 2026 — yesterday — a new draft of the CLARITY Act began circulating among Senate staff and crypto industry insiders. According to CoinDesk's reporting, the draft includes what negotiators have been fighting over for months: an ethics provision. The provision is structured as temporary — sunsetting in 2029 — and would require regulators to implement it within one year of enactment. It includes limits on President Trump's own widespread crypto involvement, which has been the central Democratic demand since committee negotiations began.

The same day, Coinbase CEO Brian Armstrong publicly announced the CLARITY Act is now set for a full Senate floor vote. That is not a neutral statement — Armstrong has been deeply embedded in the negotiations throughout 2026.

The ethics compromise matters because it was the primary obstacle to Democratic votes. Senator Ruben Gallego (D-AZ) — one of two Democrats who voted for the bill in committee — had repeatedly said he would not support it on the floor without a bipartisan ethics provision. If the July 22 draft satisfies Gallego and enough other Democrats to reach 60 votes, the bill can advance.

The Current Status — July 23, 2026

CLARITY Act — Accurate Status as of July 23, 2026
  • House: Passed 294-134, July 17, 2025 ✅
  • Senate Banking Committee: Passed 15-9, May 14, 2026 ✅
  • New merged draft: Circulated July 22, 2026 — includes temporary ethics provision (sunsets 2029) ✅
  • Senate floor vote: Announced as imminent by Coinbase CEO Brian Armstrong
  • Senate recess: Approximately August 7 — 16 days from July 22
  • Votes needed: 60 (filibuster threshold) — need 7+ Democrats
  • Polymarket odds (July 17, pre-new draft): 32% — likely higher now with ethics compromise
  • Status: Actively in play — not stalled, not dead

What's Still Unresolved

The ethics provision is the biggest unlock, but it is not the only remaining dispute. Two others remain active:

Section 604 — Law enforcement. The National District Attorneys Association has argued that Section 604 (the Blockchain Regulatory Certainty Act provision) would impair criminal investigations by shielding non-custodial developers from money transmitter obligations. Senators Warner (D-VA) and Cortez Masto (D-NV) have tied their votes to law enforcement sign-off. The White House Crypto Council secured endorsement from the National Organization of Black Law Enforcement Executives, but the core dispute has not been fully resolved in public reporting.

Stablecoin yield. The American Bankers Association argues the bill creates a loophole allowing crypto platforms to offer interest-equivalent yields (Coinbase earns ~$1.35B annually in USDC rewards) outside the GENIUS Act's prohibition. A tentative compromise emerged in committee but the banking trade groups remain formally opposed to the current language.

Whether the July 22 draft resolves enough of these remaining issues to secure the 7-9 Democratic votes needed is the central open question. Senate Democrats have not yet confirmed their floor votes publicly.

The Timeline — Why the Next Two Weeks Matter

The Senate is scheduled to leave Washington for summer recess in approximately early August — roughly 16 days from July 22. Brian Gardner, chief Washington policy strategist at Stifel, has noted that the bill "probably needs to get through the Senate by the end of July, preferably earlier" for 2026 passage to remain realistic.

The lame-duck session after the November midterm elections has been discussed as a backup window, but political conditions there are unpredictable — if the House or Senate flips, Democrats will want different terms.

This week is when the legislative outcome becomes clearer. Either the July 22 ethics compromise generates the Democratic votes needed and a cloture motion gets filed, or it doesn't — and the assessment shifts accordingly. Watch for:

  • Democratic senators publicly confirming or withholding floor support
  • A cloture motion filing from Senate leadership (this is the trigger for the formal vote count)
  • Any new CoinDesk, Politico, or Bloomberg reporting on vote whipping
  • Updated Polymarket odds — these have been the most reliable real-time signal throughout

What It Means for RWA If It Passes

The CLARITY Act establishes clear SEC/CFTC jurisdiction over digital assets, creates a market structure framework for tokenized securities and commodities, and provides the regulatory certainty that institutional capital has been waiting on since 2022. If it passes before August recess, the combination of GENIUS Act (stablecoins) + CLARITY Act (market structure) completes the two-pillar regulatory architecture the RWA sector needs for its next growth phase.

If it doesn't pass before recess, the lame-duck or 2027 windows remain — but with more uncertainty. The infrastructure build (DTCC live, Securitize public, BUIDL at $2.5B+) continues regardless. The CLARITY Act would accelerate and de-risk what's already happening rather than initiate it.
