The Week of September 15 — CLARITY's Last Day

The Digital Asset Market Clarity Act (CLARITY Act) failed its Senate cloture vote on September 15, 2026. The result was 49 in favor, 50 against — 11 votes short of the 60 needed to proceed to debate. Zero Democrats voted yes, including the senators who had spent months negotiating the bill. Four Republicans defected: Susan Collins, Josh Hawley, Jerry Moran, and Thom Tillis.

The bill is technically alive — Tillis's procedural no vote preserves a motion to reconsider. In practice, the House is dark until after the November 3 midterms, the Senate calendar is exhausted, and the 120th Congress begins in January 2027 with no guarantee of a more favorable coalition. The industry reaction: "It died."

The same day, SEC Chairman Paul Atkins confirmed the agency's administrative path: Regulation Crypto Assets, with a public comment period closing October 20. Rulemaking without legislation is slower, reversible, and narrower — but it is what the industry gets for 2026 instead of statute.

Counterpoint: nothing in the institutional RWA stack depends on CLARITY. The DTCC's October launch rests on a December 2025 No-Action Letter. BlackRock's BUIDL, Securitize's prime brokerage collateral expansion, Ondo's Asia-Pacific distribution — all operate under existing authority. CLARITY's failure is a ceiling on retail access and regulatory permanence. It is not a floor on institutional progress.

The muted reaction reflects a market that had largely priced the failure (prediction markets: 16-17% before the vote). No forced selling cascade. No collapse. The institutional RWA market moved on.

October 7–8: TOKEN2049 Singapore. The first major institutional gathering post-CLARITY. MAS Project Guardian Phase 3 announcement expected. Chainlink CCIP updates. GCC sovereign wealth positioning. Post-CLARITY Asian distribution structures from US-based platforms looking to operate under Singapore, Hong Kong, and UAE frameworks. Side-event week starts now — the deal meetings that precede the main stage often matter more.

October 20: SEC Regulation Crypto Assets comment deadline. The public comment period for the SEC's administrative crypto framework closes. The RWA sector's response to this comment process will shape what the final regulation looks like. Submit comments at regulations.gov.

October 2026: DTCC full commercial launch. All Russell 1000 stocks, major ETFs, and benchmark Treasuries available as standard tokenized settlement option for all 4,000+ DTCC member institutions.
