The Lead Story: SEC Creates Tokenized Securities Venues

The week's defining event is the SEC's Innovation Exemption, adopted September 17 and published in today's Federal Register. It creates a new venue class — Tokenized Securities Venues (TSVs) — where permissioned AMMs can trade genuine tokenized listed equity (not synthetics, not price-tracking debt instruments) under a five-year conditional exemption running to September 17, 2031.

The order's key terms: Tier 1 names (S&P 500, Russell 1000) capped at 75 symbols and 0.25% of average daily volume per name. Tier 2 names capped at 250 symbols and 2.5% ADV. Third-party tokenization subject to a 30-day issuer notice window with a binding veto right. Smart contracts must be on public permissionless ledgers. Anti-fraud rules intact. No leverage. US-kept records.

CLARITY Failed. What Replaced It.

The week opened with the CLARITY Act failing 49-50 — zero Democrats, four Republican defectors (Collins, Hawley, Moran, Tillis). The bill is dead for 2026. What replaced it in the same week: the SEC's Innovation Exemption for TSVs, Regulation Crypto Assets rulemaking with an October 20 comment deadline, and the DTCC October launch proceeding on schedule. The legislative path failed. The administrative and infrastructure paths accelerated.

The AMC vs. Robinhood Fight — and Why It Now Has an Answer

The week's most-read story: AMC CEO Adam Aron's confrontation with Robinhood after Robinhood listed a tokenized AMC token without AMC's consent. The exchange on X — Aron: "contemptible, vile." Robinhood CLO Dan Gallagher (ex-SEC commissioner): "Send your lawyers." — generated more engagement than any story we've published.

The SEC's Innovation Exemption provides the answer Aron was seeking, for the TSV market: under the new framework, a third party cannot list a tokenized version of AMC's stock on a compliant TSV without giving AMC 30 days to object. It does not reach Robinhood's current Jersey-issued instruments. But it establishes the rule for the compliant market going forward.

International: Japan and South Korea Move on the Same Day CLARITY Died

September 15 was a split-screen moment for global tokenization policy. The US Senate voted 49-50 against CLARITY. On the same day, Japan's FSA released its 2026 policy mandating blockchain-based on-chain finance — tokenized deposits, stablecoins, integrated settlement — for the first time as official government policy.

South Korea's three-stage tokenized securities plan takes effect February 4, 2027. Hanwha Group — 9.6% Securitize shareholder — has already built on Avalanche in preparation.

Markets: The $39.2 Billion Breakdown

The complete 2026 RWA market analysis published this week: $39.2 billion on-chain, 3.5 million holders, 260% year-to-date growth. The most important finding: private credit at $35.9 billion is 58% of all tokenized RWA flows — bigger than Treasuries by more than two to one, paying 8-15% yields versus Treasuries' 3.5%, and receiving almost no mainstream coverage. Maple Finance: $4.6B AUM, up 81% year-over-year. Centrifuge: $1.62B TVL, Coinbase equity stake.
